Welcome to down? (“down?”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the down? mobile application and the website at downthe.app (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use down?. By using the Service you represent that you meet this requirement and that the phone number you provide belongs to you and that you are authorized to use it.
down? uses your mobile phone number to create and secure your account. You are responsible for keeping access to your phone number and device secure. You are responsible for the activity that happens through your account.
down? helps friends turn “we should hang out” into a real plan. You can create a hangout, invite friends, see who is “down,” pick a plan, and share the final plan. Some people you invite may participate without creating a down? account, through a link you send them.
When you invite friends, you choose specific contacts from your device and down? generates a private invite link for each. You send those links to your friends using your own phone, messaging apps, or other tools. You are responsible for only inviting people who want to hear from you and for the content you send. Do not use down? to send unsolicited, harassing, or unlawful messages.
Program name: down? Account Verification. Description: down? sends one-time passcodes (OTP) by SMS to verify your phone number when you sign up or sign in. You opt in by entering your own mobile number on the phone-number screen and tapping “Send code,” which requests a verification code at that number. These messages are transactional only — down? does not send marketing or promotional texts.
Message frequency: message frequency varies; you receive a code only when you request one (typically one message per sign-in). Cost: message and data rates may apply. To opt out, reply STOP at any time to stop receiving messages. For help, reply HELP or contact support@downthe.app. Carriers and mobile providers are not liable for delayed or undelivered messages.
down? does not sell or share your mobile number or SMS consent with third parties for their own marketing. SMS consent is not a condition of any purchase. Friend invites are sent by you, from your own phone’s messaging app — down? does not text your friends on your behalf.
You agree not to: (a) use the Service for any unlawful purpose; (b) harass, threaten, or harm others; (c) attempt to access accounts, data, or systems you are not authorized to access; (d) interfere with or disrupt the Service; or (e) scrape, reverse-engineer, or misuse the Service or its data.
down? has zero tolerance for objectionable content and abusive behavior. You agree not to post, send, or share content that is harassing, threatening, hateful, sexually explicit, or otherwise objectionable, and not to abuse, impersonate, or harm other users. By using down? you agree to these terms.
Every message in a hangout chat can be reported, and any user can be blocked (blocking hides their messages and removes them from hangouts you host). We review reports and, where content or behavior violates these guidelines, remove the content and remove the offending user within 24 hours. To report abuse or content outside the app, or to appeal an action, email support@downthe.app.
You retain ownership of the content you create in down? (such as hangout names, preferences, and plans). You grant us a limited license to store and process that content solely to operate and provide the Service to you and the people you invite.
down? is offered “as is” and “as available.” We may change, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, down? disclaims all warranties, express or implied. down? is not responsible for plans that don’t come together, for the conduct of other users, or for the venues, activities, or third-party services referenced in the app. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the past twelve months (which may be zero) or USD $50.
You may stop using down? and delete your account at any time from within the app (Settings → Delete account). We may suspend or terminate access if you violate these Terms or to protect the Service or its users.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
